GENERAL TERMS AND CONDITIONS

Online sales are governed by an almost overwhelming number of regulations and laws, some good, some less useful or even impractical, all of which we are of course required to follow. In practice, we strive to provide every customer with the maximum level of service we can offer. We guarantee every customer all rights provided by law, and the same terms apply equally to everyone, whether they are familiar with them or not.

However, you may take a little more time and continue reading to familiarize yourself in detail with all policies and terms governing our business operations, which we publish in accordance with applicable legislation.

INTRODUCTION TO THE GENERAL TERMS AND CONDITIONS

In cooperation with selected manufacturers, distributors and retailers from Slovenia and abroad, we enable the comparison and purchase of approximately 400,000 offers. We deliver orders to addresses in Slovenia, Austria, Croatia, Germany and Italy.

We carefully monitor quality and pricing, which is why we are a preferred supplier for businesses, public institutions and personal customers. We primarily ensure customer satisfaction through:

  • careful and up-to-date publication of accurate information about our offers,
  • ensuring the technical and legal security of our visitors and customers,
  • protection of personal data,
  • special attention to customer needs and a commitment to resolving issues, misunderstandings and complications.

REGISTERED USERS – MEMBERS

Each registered user has their own username and password, which they use to identify themselves either personally or as a representative of a company or organization. If you purchase for yourself and for a company, for multiple companies, or if for any other reason you require multiple Enaa accounts, you may create two or more Enaa accounts using either different or the same email address. If you wish to have two or more user accounts with the same email address, please choose a different password for each account.

Please do not use your personal Enaa account for orders placed on behalf of legal entities! In such cases, create a separate account for the company.

Your personal account (one only) may be linked to one or more company accounts for which you also make purchases. This allows you to receive loyalty points for purchases made on behalf of those companies.

Passwords are confidential and known only to the user. The user is responsible for providing accurate information and safeguarding their credentials so that only they, or a person authorized to act on their behalf, uses the account and password.

BENEFITS FOR REGISTERED USERS

Free registration includes unlimited access to advanced functionality such as direct online order tracking, online chat with Enaa support, easier issue reporting and case tracking, cash-on-delivery payment (where available), management of multiple user accounts, personal selection pages, purchase history and other useful features.

Registered users can:

  • purchase under the most favorable conditions,
  • track the status of received orders online,
  • access customer support chat more easily,
  • report issues and monitor their resolution more conveniently,
  • pay cash on delivery (where available),
  • receive free e-magazines if they subscribe,
  • contribute content and share product ratings and opinions,
  • participate in prize draws and contests.

Special discounts, free delivery offers and other benefits expire no later than one year after the last purchase unless otherwise specified.

THE BEST SUPPLIER FOR BUSINESSES AND ORGANIZATIONS

A registered user who creates an Enaa account for a company, organization or other legal entity declares by registering that they are authorized to accept these terms on behalf of that legal entity and may place orders and make purchases through Enaa, as well as authorize other representatives of that legal entity to do so.

Commercial terms that exceed the published general terms (such as extended payment deadlines, credit limits and similar arrangements) may be agreed upon through a separate written agreement, taking into account the expected and actual order volume through Enaa. Terms agreed between Gambit trade d.o.o. and companies, organizations, government institutions, local authorities, public education institutions and public healthcare organizations do not apply to other users or customers.

We enable companies and organizations to receive e-invoices and enter purchase order numbers before placing orders.

The seller reserves the right to reject orders from customers who are overdue with payments for ordered goods and related late-payment interest. During the suspension of an open account, the customer may continue purchasing under the same conditions only with 100% advance payment for each order.

The seller may permanently or temporarily disable ordering through Enaa for business customers without notice in the following cases:

        • if the customer is late with payments at least three consecutive times;
        • if the customer enters bankruptcy, liquidation or otherwise becomes insolvent;
        • if the customer does not comply with these terms;
        • if the customer performs no business transactions with Gambit trade within one year after registration;
        • if the customer discloses or enables the disclosure of confidential business information (agreed discounts, copying published materials, etc.).

WHOLESALE

Inventory levels at Enaa are optimized for the needs of consumers and business customers, not for our wholesale program. We reserve the right to reject large-quantity orders from companies that do not have a wholesale agreement with us, or whose orders are not in accordance with agreed wholesale terms. Standard consumer and business orders take priority.

DEFINITIONS

A customer may be either a consumer or a legal entity, based on the information provided during registration or order placement. A consumer is a natural person who acquires or uses goods and services for purposes outside their trade, business or professional activity. All other customers are considered legal entities.

By registering, the customer confirms that they accept the General Terms and Conditions published on this website, as well as any other published policies and future amendments that may be published by the operator.

The website is optimized for the latest versions of Microsoft Edge, Google Chrome and Mozilla Firefox browsers. If you use a different browser, we cannot guarantee a complete user experience. In such cases, some content may not be displayed correctly or may appear differently. The same applies when browsing our website with cookies disabled, various filters or security settings enabled, ad blockers installed, or similar software in use.

PRICES, DISCOUNTS AND OTHER COMMERCIAL TERMS

On product pages we publish the best available Enaa retail price. This price includes all discounts determined by us, supplier discounts and any other discounts that are not separately displayed.

Discount codes may provide an additional discount on published retail prices or free delivery of your order to an address in Slovenia, subject to the applicable free-delivery conditions.

Published prices may change without prior notice. For individual purchases, the prices valid at the time the order is placed shall apply. Issued quotations remain valid until the conditions change.

Special offers, clearance sales, extra discounts, discount codes, gifts with purchase and other promotional campaigns remain valid until the last item is sold or until the specified expiration date, whichever occurs first.

All published prices and estimated delivery times apply to one (1) unit and include VAT unless otherwise stated.

Only one promotional benefit may be applied per purchase. No discounts can be applied to products marked as "Lowest Price". For these products we have already established the best possible selling price for all customers, regardless of whether they possess discount codes or qualify for additional benefits, and therefore no purchase can be completed below the published price.

Published prices and commercial terms apply equally to all customers and are not determined through automated profiling or personalized pricing. Special conditions may apply to:

  • companies, organizations and institutions of state administration, local government, public education and public healthcare under separate written agreements based on actual and expected business volume;
  • members of the Association of Free Trade Unions of Slovenia;
  • holders of the EU Disability Card;
  • customers who have obtained special conditions for a limited period through specific promotions organized by us or our partners.

ORDERING – CONCLUSION OF DISTANCE SALES CONTRACTS

Contracts are concluded in the Slovenian language. Contracts and invoices are stored electronically at the company's registered office. If you have misplaced, lost or cannot find your documents, please contact Sales & Support

Printed invoices are issued only upon the customer's explicit request. More information is available on the page No Invoice – No Worries.

The customer may cancel an order without any additional obligations from the moment it is placed until receiving an email notification that the order has entered processing.

After placing an order, the customer receives an automatic email confirming receipt of the order and a separate email informing them that order preparation has begun. These messages do not constitute confirmation of the conclusion of the sales contract but merely acknowledge successful order placement and the start of order processing. The moment of contract conclusion depends on the selected payment method, as described below:

  • the purchase contract is not concluded until we send you an email informing you that the products have been dispatched or are ready for collection at our pickup location. At that time the invoice is issued and payment is processed;
  • in the case of payment by pro forma invoice, the purchase contract—regardless of the above—is deemed concluded when your payment is received in our bank account. Upon receipt of payment, we will process the order and send a dispatch notification. In the case of payment by credit card or installment financing, only an authorization (reservation of funds) is performed when the order is placed, which does not constitute actual payment. Although the purchase contract in the case of pro forma payment is considered concluded upon receipt of payment, we reserve the right to cancel the order and refund the received amount in the event of inventory discrepancies, pricing system errors or other justified reasons preventing fulfillment of the order. In such cases you will be notified immediately and your payment will be refunded in full. See also the section Order Fulfillment or Rejection. 

The customer may cancel the order and withdraw from the contract without additional obligations from the moment the order is placed until receiving an email notification that the order has entered processing.

ORDER FULFILLMENT OR REJECTION

Gambit trade may refuse to conclude a contract or may withdraw from a contract, including but not limited to the following situations:

  • when unforeseen circumstances result in an obvious error in the published price or in the essential characteristics of a product, when the product is no longer available in stock, and similar situations; 
  • when products do not comply with safety regulations or other legal requirements governing the sale of products such as children's products, protective equipment, medical devices and similar product categories. Such products may occasionally appear on the Enaa marketplace through automated data exchange before we complete our final content review. These products are reviewed before order fulfillment and, where necessary, the order may be rejected.
  • if the customer violates our General Terms and Conditions or other applicable policies.

Inventory information is updated continuously. Although we strive to publish accurate information, estimated delivery times shown at the time of order placement may occasionally not reflect the actual warehouse situation, especially in cases of errors that can only be identified after the order has been placed, such as product or packaging damage, loss or theft in the warehouse, technical issues in electronic data exchange, delays caused by communication failures, and similar circumstances. In these and similar cases, we may be unable to fulfill your order as agreed and will therefore cancel the order.

As a retailer, in accordance with Slovenian legislation and the principle of free economic initiative (Article 74 of the Constitution of the Republic of Slovenia), we reserve the right to decide independently with whom we conduct business. Consumer protection legislation grants consumers specific rights when making purchases, but it does not require a retailer to sell products to every individual if justified grounds for refusal exist. We guarantee that any refusal of sale will never be based on discrimination related to gender, age, nationality, religion or any other personal circumstance. Refusal of sale or business cooperation may only occur where justified reasons exist, such as:

  • offensive or disrespectful communication with employees,
  • excessive burdening of employees with unproductive inquiries that disrupt business processes,
  • an unusually high frequency of uncollected orders or returned products causing business losses,
  • reasonable suspicion that the customer is purchasing products for resale without appropriate registration, thereby potentially contributing to undeclared economic activity.

All documents must be retained in their original form. For this reason, submitted orders cannot be modified. An order that cannot be fulfilled may only be cancelled. After cancellation, you may place a new order yourself or in consultation with us, and we will make every reasonable effort to accommodate your request. We appreciate your understanding and cooperation in resolving such situations.

WITHDRAWAL FROM CONTRACT, COMPLAINTS AND WARRANTY

Consumers who conclude distance contracts in accordance with consumer protection legislation have the right to withdraw from the contract within the statutory period without stating any reason for their decision. PURCHASE OF HEAT PUMPS AND AIR CONDITIONERS WITH OUTDOOR AND INDOOR UNITS

When selling heat pumps and air-conditioning systems consisting of indoor and outdoor units, and in accordance with Article 8 of the Regulation on Fluorinated Greenhouse Gases and Ozone-Depleting Substances, we ensure that installation is carried out by authorized installers:

Customers purchasing a heat pump or air-conditioning unit containing fluorinated greenhouse gases and which is not hermetically sealed (air conditioners with indoor and outdoor units, heat pumps) must, before receiving the purchased product, complete a declaration identifying the authorized installer who will perform the installation:

EU DISABILITY CARD BENEFITS

Enaa actively supports persons with disabilities. Holders of the European Disability Card are entitled to free advice and assistance with distance purchases (telephone, email and chat support). By prior arrangement, we can also provide delivery of purchased products to upper floors, installation services and removal of old equipment. ENAA DOUBLE WARRANTY AND ENAA MOBILE WARRANTY

Enaa Double Warranty and Enaa Mobile Warranty are optional product protection services that customers may select when purchasing eligible products.
Enaa Mobile Warranty provides additional protection for mobile phones and tablets against sudden and unforeseen damage such as drops, impacts or liquid spills, and may also include protection after the manufacturer's warranty period has expired, subject to the terms of the service.

DISPOSAL OF OLD ELECTRICAL AND ELECTRONIC EQUIPMENT

When purchasing a new electrical product, our delivery service can also collect your old equipment and take it to an authorized collection point. For products where this service is available, you may select this option beneath the "Add to Cart" button.

You may also dispose of waste equipment free of charge at an authorized collection center or during bulky waste collection campaigns organized in your area.

ENVIRONMENTAL RESPONSIBILITY

In accordance with the principle of Extended Producer Responsibility, Gambit trade d.o.o. fulfills its obligations arising from European Directives 2012/19/EU and 2006/66/EC, the Slovenian Regulation on Waste Electrical and Electronic Equipment and the Regulation on Batteries, Accumulators and Waste Batteries and Accumulators through joint waste management schemes operated by TRIGANA d.o.o.

Waste Electrical and Electronic Equipment (WEEE)

The crossed-out wheeled bin symbol displayed on a product, its packaging or user instructions indicates that the product must not be disposed of as mixed municipal waste and that it was placed on the market after 13 August 2005. It is your responsibility to deliver such equipment to designated collection points for separate waste collection operated by local municipal services. You may also return the old device directly to a retailer or distributor when purchasing a similar product. By doing so, you fulfill your legal obligations and contribute to environmental protection.

Separate collection and recycling of waste electrical and electronic equipment help prevent environmental pollution and health risks resulting from improper disposal, while also enabling the recovery of valuable materials, reducing energy consumption and conserving natural resources.

If the product you intend to discard is still functional, please consider donating it to a reuse center. This extends its useful life and helps prevent unnecessary waste.

Waste Batteries and Accumulators

The crossed-out wheeled bin symbol displayed on batteries, accumulators, packaging or user instructions indicates that batteries and accumulators must not be disposed of as mixed municipal waste. It is your responsibility to take them to designated collection points for hazardous waste operated by local municipal services. Waste batteries and accumulators may also be returned to retailers or distributors without the obligation to make a new purchase. By doing so, you fulfill your legal obligations and contribute to environmental protection.

If a chemical symbol is printed below the symbol shown above, it indicates, in accordance with applicable legislation, that the battery or accumulator contains a heavy metal above the legally permitted threshold (Hg = mercury, Cd = cadmium, Pb = lead).

If a device contains batteries or accumulators that cannot be easily removed without compromising user safety, the device must be disposed of together with the waste electrical and electronic equipment through the appropriate collection system.

SALE OF WINE AND ALCOHOLIC BEVERAGES

The Minister of Health warns: Excessive alcohol consumption is harmful to your health. We do not sell wine or other alcoholic beverages to minors. By placing an order, you agree that we may verify your age at any time before completing the order and that we may refuse delivery if you are under the legal drinking age.

PRIZE DRAWS AND COMPETITIONS

The participation rules for each individual prize draw or competition are published on the respective campaign page. Unless otherwise specified, the following general rules for prize draws and competitions shall apply.

RANKING OF OFFERS AND ADVERTISING

All products displayed on Enaa, whether as search results, category listings, department pages or homepage selections, are ranked according to popularity. The Enaa system calculates the current popularity score of every product twice daily. The calculation takes into account:

  • the number of orders received during the previous twelve months, with more recent orders carrying greater weight than older orders,
  • customer ratings and reviews.

For certain product displays, the system may also consider estimated delivery times and the seller's rate of delays and fulfillment errors.

Higher popularity rankings are never the result of payments made by sellers or editorial decisions by Enaa.

Information about a customer's previous activities within My Enaa does not affect product popularity rankings or product display order for that customer.

Enaa also curates and highlights special product selections. These products are identified by badges. Such badges do not influence popularity rankings.

Advertising sections display sponsored offers identified with the label "Advertisement" as well as products included in promotional campaigns. Advertising and promotional placement do not affect product popularity rankings.

EDITORIAL POLICY

Content is managed by the editorial team as well as suppliers and users, whom we allow to publish videos, photographs, text and other materials, and to rate, comment on and discuss our offers.

User ratings and opinions represent solely the personal views of their respective authors. Enaa assumes no responsibility for their content or accuracy; however, we reserve the right to remove offensive or inappropriate content. Ratings, opinions and questions reflect consumers' interest in freely sharing information and opinions about products and learning about their features, advantages and disadvantages, including through the experiences of other users.

All users access and use the services at their own risk and are fully responsible for the legality, accuracy and content of any materials they submit. Users bear sole responsibility for any information, opinions, advice, statements, data or other materials they provide or publish.


The posting, transmission, uploading, linking to or distribution of sexually explicit, pornographic, offensive, violent, threatening, racist, inaccurate, unlawful or otherwise ethically questionable content, or content that infringes copyright, related rights, personality rights or any other legal or constitutional rights of third parties, regardless of nationality, whether in the form of statements, files or any other format, is strictly prohibited.

The publication or disclosure of information or materials protected by intellectual property rights, copyright, personality rights or other rights of third parties (including privacy rights and protection against disclosure of personal data) is prohibited.

Please do not post content related to competing retailers, competing brands or links to such content, as we do not have permission from those parties to publish it. Such content will be removed.

The editorial team reserves the right to monitor and review any information or material submitted by users or members through the website's services and may remove, relocate or modify any material that, in its opinion, violates these terms. However, due to the nature of the service and medium, the editorial team cannot review every new submission and does not undertake to exercise complete control over all published content, nor does it guarantee the accuracy of submitted information or accept responsibility for any loss or damage resulting from such information or its removal.

Each user agrees to attempt to resolve any alleged violations of their rights by another user amicably with the party responsible. If the issue is not resolved, the user shall notify the editorial team at Enaa Editorial Team. Action will be taken only upon receipt of a report that includes the following statements from the reporting party:

  • that they are authorized to submit the request, that the information provided is accurate and verified, and that they accept full responsibility for it;
  • that they have reasonable grounds to believe that publication of the reported content was not authorized by the copyright owner, the owner's representative or a competent agency, and that no legal basis exists for such publication;
  • that they accept full responsibility for the consequences of removing or modifying the reported content.

Based on such reports, the editorial team undertakes to classify the content as:

  • disputed content,
  • content for which the author has not obtained all necessary rights (including copyright and related performer rights),
  • or content that is otherwise ethically or legally objectionable,

and shall remove or modify the content as quickly as reasonably possible in accordance with the request. In other cases, the editorial team will notify the author and address the matter in cooperation with them.

Suppliers, users and members agree to release the editorial team, website owners, employees, contractors and other authorized persons from any liability for loss of data or any other inconvenience, damage or issues resulting from misuse of the website services by themselves or by other users. Neither the editorial team nor the operator shall be liable for any interruption of service, regardless of the cause.

Any disputes arising from the use of the website services, these General Terms and Conditions or involving Gambit trade d.o.o. shall be governed exclusively by the laws of the Republic of Slovenia. All parties agree that, regardless of their geographic location, nationality or affiliation, only Slovenian law shall apply. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply. Exclusive jurisdiction for all disputes and legal proceedings shall lie with the competent court in Ljubljana, Slovenia.

The operator reserves the right to amend the conditions of access to services for members and users at any time, with changes becoming effective upon publication.

COPYRIGHT

All published content and technologies are the property of Gambit trade d.o.o. Copyrighted works include, in particular, all source code, software architecture and engineering solutions, graphic elements, images, audio and video materials and other creative works that do not need to be specifically marked as copyrighted. The structure and conceptual solutions of the website are also protected. Any copying, reproduction, imitation, recording, citation or distribution without the consent of Gambit trade d.o.o. is prohibited.

PERMISSION TO USE

Users may use the content and services in accordance with the terms set out above. Any other use of the content requires prior agreement with the operator.

The following activities are expressly prohibited:

  • theft or copying of the database, in whole or in part,
  • copying, distributing, modifying or otherwise disseminating content in any manner other than copying results for personal use,
  • modifying the website, incorporating it into another website, selling or upgrading any part of the website or the website as a whole,
  • imitating or engaging in activities that could damage the reputation, operation or use of the website and/or its operator,
  • the use of automated queries or automated tools (including crawlers, robots, spiders or scrapers) that automatically collect data from the website or otherwise automatically interact with the website, except for Google and Bing search engines,
  • the use of computer code, malicious software or anything that could disrupt, disable or damage the service, the service provider or its software and hardware infrastructure,
  • any use of the service that is contrary to applicable laws and public order.

PERSONAL DATA PROTECTION

We collect, process and protect personal data in accordance with applicable personal data protection legislation. Personal data, the collection and use of personal data, and personal data protection form an integral part of our General Terms and Conditions and can only be fully understood together with them. We will use your email address at a minimum for communications related to your orders, including:

  • an invitation to participate in a customer satisfaction survey (approximately 7 days after purchase),
  • a thank-you message including information about loyalty points collected and the benefits associated with those points.

We also use a dedicated customer communication system that helps ensure that nothing on Enaa is overlooked, forgotten or handled incorrectly. The system will send you appropriate notifications whenever necessary.

You can manage your consent to receive commercial communications at any time through your user profile.

EXPORT AND SALES RESTRICTIONS

Gambit trade d.o.o. operates in compliance with the legislation of the Republic of Slovenia and the European Union. We reserve the right to reject any order where there is reasonable suspicion that the goods or services may be directly or indirectly redirected to such countries or used in violation of applicable laws. We also reserve the right to reject orders from companies, entities or individuals where there is reasonable suspicion that they cooperate with, or intend to cooperate with, parties located in countries subject to international sanctions or restrictions.

At Gambit trade d.o.o., we are committed to ensuring that no goods or services are sold, supplied or otherwise made available to countries, business entities or individuals subject to international sanctions.

To effectively implement these restrictions, we operate an automated compliance monitoring mechanism connected to the official EU Consolidated Sanctions List, available at:

Our information system is directly integrated with this database, enabling automatic and up-to-date verification of all business entities, customers and recipients. As soon as a country, organization or individual is added to the official sanctions list, the system automatically prevents any business activity with that entity, including order processing, document issuance and delivery.

In this way, we ensure that our business practices remain compliant with EU legislation and international regulations while minimizing potential risks to our company and our business partners.


COMPLIANCE WITH LEGISLATION

When selling products through the Enaa website, Gambit trade d.o.o. acts as the seller of goods and not as an intermediary platform or online marketplace. The sales contract for products published on the website is concluded directly between the customer and Gambit trade d.o.o., which acts as the supplier, seller and issuer of the invoice.

Enaa does not allow third-party sellers to publish offers and does not operate as an intermediary platform for contracts between customers and other suppliers.
Products are included in our offer based on our own sales policy and a verified supply chain within the European Union or from economic operators that ensure compliance with applicable legislation. In cases where a product is shipped directly from a supplier or manufacturer to the customer (so-called direct delivery), this does not affect our status as the seller in relation to the customer.

We ensure that all material product information relevant to purchasing decisions is published in accordance with consumer protection legislation, e-commerce legislation and regulations governing distance selling.

We ensure the publication of manufacturer or importer identification details and other product information whenever required by applicable product safety legislation.

The Enaa information system is designed to restrict the publication of products lacking mandatory compliance information whenever such information is required by law.

Gambit trade d.o.o. and its customers regulate their mutual rights and obligations in accordance with these General Terms and Conditions and the applicable laws of the Republic of Slovenia and the European Union, particularly in the areas of consumer protection, e-commerce, personal data protection, product safety and energy labeling.

EU ENERGY LABELS (EPREL)

For products published on Enaa, we ensure the display of energy labels and related product information sheets in accordance with European Union energy-labeling legislation, particularly Regulation (EU) 2017/1369 and the related delegated regulations applicable to specific product groups.

For products subject to mandatory energy labeling, the Enaa information system automatically prevents publication of product offers without a valid EPREL identification number and a corresponding link to the product record in the EPREL (European Product Registry for Energy Labelling) database maintained by the European Commission.

For such products, we provide:

  • display of the product energy efficiency class,
  • display of the official energy label,
  • access to the product information sheet,
  • a link to the relevant EPREL record whenever required by law.

The display of energy labels and related information is also ensured throughout the distance-selling process in accordance with European Union legislation governing online sales of products subject to mandatory energy labeling.

Energy-label information is based on official data provided by manufacturers or suppliers registered in EPREL. Despite automated verification procedures, discrepancies may occasionally occur, particularly due to changes or corrections made by manufacturers, suppliers or the EPREL registry itself.
