Guarantee to the buyer of the product

The Merchant is obliged to attach a guarantee to each product sold. The Mercahant guarantees the buyer's rights under the guarantee even if the guarantee was not attached to the product sold. 

The Merchant guarantees the following to the buyer: 

The trader, alone or in agreement with the seller, importer, manufacturer or third party from whom the product was purchased, guarantees the characteristics and trouble-free operation of each product sold within the warranty period, which begins with the sale to the end customer through Enaa and lasts at least one year, in the territory of Slovenia, provided that the product is handled properly and in accordance with the enclosed instructions.

The buyer may invoke the warranty by means of a delivery note or invoice, warranty card or other documents showing the date of delivery of the goods and a description of the defect, which shall be delivered together with the goods to an authorised repairer. The buyer may authorise the administrator (Enaa) to exercise his rights.  

If the goods do not meet the specifications or do not have the characteristics stated in the warranty card or advertising message, the buyer may first request that the defects be rectified. 

If the defects are not rectified within a total of 30 days from the day we receive the request for rectification from the consumer, the trader will replace the goods free of charge with identical, new and faultless goods.

The time limit referred to in the preceding paragraph may be extended to the minimum time necessary to complete the repair or replacement, but by no more than 15 days. In determining the extended period, account shall be taken of the nature and complexity of the goods, the nature and severity of the non-conformity and the effort required to complete the repair or replacement. The trader shall inform the buyer of the number of days for the extension and the reasons for the extension before the expiry of the period referred to in the preceding paragraph.

If the trader fails to repair or replace the product with a new one within the time limits set out in the previous two paragraphs, he shall, at the buyer's request, refund the full purchase price or a proportionate reduction of the purchase price.

If the buyer requests a proportionate reduction of the purchase price, the reduction of the purchase price will be proportionate to the reduction in the value of the goods received by the buyer compared to the value the goods would have had if they had been in conformity.

The trader will also refund the full purchase price to the buyer at the buyer's request if the non-conformity occurs less than 30 days after delivery of the goods.

The trader will issue a new warranty certificate for the replaced goods or for the replacement of an essential part of the goods with a new one.

The trader will, as far as possible, provide the buyer with the use of similar goods free of charge for the duration of the repair of the goods for which a mandatory guarantee has been issued. If this is not possible, the trader will compensate the buyer for the damage suffered as a result of not being able to use the goods from the time the buyer requested the repair or replacement until the time the repair or replacement was carried out.

The trader shall also bear the costs of materials, spare parts, labour, porterage and transport of the products incurred in rectifying the defects or replacing the goods with new ones. 

The trader shall provide the buyer with paid maintenance, spare parts and attachments for the purchased goods for three years after the expiry of the warranty period.

The guarantee does not exclude the buyer's rights under the statutory guarantee of conformity of the goods.

The consumer has the legal right to assert warranty claims against the seller free of charge in the event of non-conformity of the goods.

he guarantee may be invalidated by misuse or damage caused by negligent handling, by connection to the wrong voltage or type of current, by improper use, negligent handling, mechanical damage and failure in the event of force majeure (power surge, lightning.... ), if the product has been tampered with by an unauthorised person or if it is found that the product has been tampered with without our written permission, in the case of alterations to the goods, unprofessional addition of construction assemblies, arbitrary wiring of elements such as switches, potentiometers, plugs, etc., the use of other components not originally belonging to the goods. 

The guarantee does not apply to consumables (batteries, cartridges, toners, paper, etc...) and data on data carriers. 

The trader may also provide the buyer with additional guarantees, warranties and benefits beyond the minimum legal conditions set out above.

Compliance with legislation

The Merchant confirm and warrant that it will only submit for publication products on Enaa that are safe and comply with the ZIUSVP and Regulation (EU) 2023/988 on general product safety.

The Merchant guarantees that it publishes and sells on Enaa only products with the relevant attestations, certificates and statutory markings, EAN and EPREL numbers for products where these are legally required or customary and other information required by law, instructions in the Slovene language, the relevant warranty statement and instructions for use. The Merchant shall provide adequate after-sales service, spare parts and other conditions of sale. 

The Merchant shall ensure and be responsible for adequate outgoing quality control of the products sold and for the supply of 100% quality products. The Manager may sell and dispense the dealer's products to customers without further quality testing, and the dealer shall provide a new product or a refund to the customer in the event of a defective product issue (DOA). 

Compliance with delivery deadlines

As a general rule, the trader offers products from its own stock or products that can be delivered within 3 days. The trader may also publish part of the offer with longer delivery times, and by publishing it, the trader confirms that he has adequate guarantees for delivery within the stated delivery times.

The trader shall be responsible for compliance with the published delivery times. In cases where the buyer withdraws from the contract due to the delay of the merchant and rejects the order after it has already been sent to his address or to the address of the manager, the merchant shall be obliged to take back the returned or unclaimed product(s) and to reimburse the manager for the related costs in the amount of 20,00 €+ VAT on a case-by-case basis.

In the event of repeated delays, the manager may extend the published delivery times of the trader accordingly, firstly by extending them and then by suspending the publication of their offers.

Full acceptance of liability

In the event that the administrator receives a claim or is the subject of a lawsuit alleging that, in connection with the sale of the merchant's products and services, there has been any infringement of third party rights or damage arising from the merchant's sphere of activity (product quality, delays, non-conformity of goods, attestations, certificates, warranty declarations, service, defective documentation, etc.), the administrator shall not be liable for any damages arising from the merchant's products or services, declarations and the like), the merchant undertakes to indemnify and hold the manager harmless from and against such claims (including, if necessary, by entering into any litigation) and damages, and to reimburse the manager for any damages and/or other compensation awarded or agreed to be awarded and/or payable to third parties by the manager (including costs and attorneys' fees). The obligations of the parties to the contract shall include, but not be limited to:
•    the manager to notify the trader as soon as possible of any claim or action, inspection or infringement proceedings (hereinafter collectively referred to as "claims");
•    upon the request of the trader, the manager shall provide the trader with information in the possession of the manager which is necessary for the defence of the rights of the manager and the trader
•    at the request of the trader, the administrator will cooperate with and assist the trader in the defence of any such claim or action to the extent reasonably requested by the trader.
